1. Introduction
Welcome to FrostLine. These Terms and Conditions ("Terms") govern your access to and use of the FrostLine website (the "Service"), operated by FrostLine Media Group ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
FrostLine is a digital platform dedicated to curating and listing winter sports events across Canada. Our mission is to connect enthusiasts with skiing, snowboarding, ice hockey, and skating events. Please read these terms carefully before using our platform to find events or submit listings.
2. Use of the Service
By using our Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into binding contracts. You agree to use the Service only for lawful purposes and in accordance with these Terms.
- You must not use the Service in any way that violates any applicable federal, provincial, local, or international law or regulation.
- You must not engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm FrostLine or users of the Service.
- You must not use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
3. Event Listings and Accuracy
FrostLine strives to provide accurate and up-to-date information regarding winter sports events. However, we act primarily as an aggregator of information provided by third-party organizers. We do not guarantee the accuracy, completeness, or timeliness of any event details, including dates, times, locations, or ticket prices.
Organizer Responsibility: Event organizers who submit listings to FrostLine are solely responsible for the content of their listings. By submitting an event, you warrant that all information is accurate and that you have the authority to publish such information.
4. Liability Waiver & Assumption of Risk
Inherents Risks of Winter Sports: You acknowledge that the events listed on FrostLine involve winter sports activities (including but not limited to alpine skiing, snowboarding, and ice skating) which carry inherent risks of physical injury, disability, or death. These risks may result from weather conditions, terrain features, equipment failure, or the actions of others.
No Liability: FrostLine is an information service provider and does not organize, supervise, or control the events listed on our platform. We are not liable for any personal injury, property damage, financial loss, or other damages arising from your participation in any event found through our Service. You participate in all events entirely at your own risk.
By using this Service, you voluntarily release, waive, and discharge FrostLine, its officers, directors, employees, and agents from any and all claims or causes of action arising out of or related to your participation in any listed event.
5. Intellectual Property Rights
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by FrostLine, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms permit you to use the Service for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent.
6. Third-Party Links
Our Service may contain links to third-party websites or services (such as ticketing platforms like Ticketmaster or local resort pages) that are not owned or controlled by FrostLine. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that FrostLine shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
7. Termination
We may terminate or suspend your access to all or part of the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the federal courts of Canada or the courts of the Province of Alberta.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
